1. Review the proposed Indian Brook-Croton Gorge Watershed Overlay Zone. 

Five municipalities, Cortlandt, New Castle, Town and Village of Ossining, and Village of Croton   formed the Indian Brook-Croton Gorge Watershed group many years ago to protect the water supply in these watersheds.  The group has issued an RFP to undertake the study and development of a Watershed Overlay zone that would establish protective zoning rules in the watershed area.  Before the RFP is finalized it must be reviewed and approved by the municipalities involved.   The Board will discuss whether the Village wishes to proceed with the development of such an overlay zone. The majority of the IBCG watershed area does not have municipal water or sewers.

2. Discussion regarding a proposed mural to be painted at Senasqua Park.  Local artist Dillon O’Keefe is proposing a mural on the wall of the Bathhouse at Senasqua Park which depicts the words “Croton-on-Hudson” against a sunset on the Hudson River.

3. Review the vendor usage of Senasqua Park under the revised permitting process.  The Board will discuss the billing/fee process under the current permitting process whereby vendors pay a  permit fee and are later billed a fee to cover the presence of a Park ranger.

4. Review of survey results regarding the residential parking permit system on Young Avenue and Hastings  Avenue.   In 2019, the Village conducted a survey for residents of Young and Hastings Avenues regarding their preference for time-limited parking on the street vs a residential permitting system.  Based on the results at that time, the Village requested our NYS representatives to introduce bills in the State Assembly and Senate permitting residential parking permits on a public street.  It was approved.  However, since changes have occurred in parking due to the pandemic, the Village sent a 2021 survey which indicated a negative interest.  (Survey results are in the back up documents.)  The Board will discuss how it wants to move ahead or not on this matter.

5. Discussion regarding the Marijuana Regulation & Taxation Act and its possible impact on Croton-on-Hudson.  The Board must decide whether to “opt out” or not of the provisions of the recently passed Marijuana Law. The Village can always “opt -in” at any time in the future but must decide whether to “opt-out” by December 31, 2021. 

 The following questions will also be discussed:  1) Shall the Village Code section prohibiting smoking and vaping tobacco in parks and recreation areas be expanded to prohibit the smoking and vaping of marijuana in those areas? 2) Shall the Village adopt a local law prohibiting dispensaries of marijuana and other cannabis products within the Village boundaries? 3) Shall the Village adopt a local law prohibiting cannabis consumption sites (“lounges”) from operating within the Village boundaries?

If the Board decides to proceed with a local law prohibiting either #2 or #3, the law must be passed by December 31, 2021. The Village can always “opt-in” at a future date,  but cannot “opt-out” after December 31st. The local laws are subject to permissive referendum, so it would be our recommendation to adopt the laws by the beginning of September to permit the referendum question to be added to the November 2021 ballot, if necessary, and avoid the expense of a special election.

Dear Neighbors: I am writing to introduce myself to you as the Democratic and Working Families Party candidate for the Croton-on-Hudson Board of Trustees. Croton is a beautiful village. Genuinely caring, thoughtful, and dynamic; this community faces the future with an open heart. That is important to me, my wife, and our overall values that we have tried to instill in our young family. It is with great privilege to give back to the Village that has given us so much. A former community college student, I earned my B.A. in Int’l Development Studies after transferring to UCLA. My master’s degree from the School of International & Public Affairs at Columbia University focused on Int’l Finance. I also bring with me a twenty-year professional background in the private and non-profit sectors. I have worked with groups such as humanitarian and development nonprofits as well as global banking and asset management enterprises. During my time in this Village, I have volunteered with the Croton-Cortlandt Food Pantry and the Holy Name of Mary’s Hispanic Ministry, among other local groups. As a Trustee, I will leverage my skillset to benefit the Village by focusing on attracting investment and overseeing prudent financial management. My background as an immigrant from Honduras also informs my decision to seek public office. I would like to provide a platform of representation that makes space for all Village residents.  Not only do I remember the LA Riots vividly (in response to brutal police beating of Rodney King), but I come originally from a region that has witness much conflict (to this day). It is from this experience that I firmly state: we cannot go down the self-destructive path of hate. We can and must find ways to do better. We must engage in a more meaningful way with each other. With your support, I look forward to doing so as Village Trustee. Core to my values are fairness, truth and collaboration, and I hope to apply these as a Village Trustee. In the eight years we have been here, I have witnessed touching points of humanity during tumultuous times, learned from others I have had the privilege to help, and benefited directly from the warmness of Croton residents. I have hope that we can continue to build a loving community that supports each other, makes room for growth, and prioritizes access and representation. With your support, we can make that vision a reality.

PUBLIC HEARINGS:


1.
Public Hearing on Local Law Introductory 4 of 2021 to amend Chapter 197 of the Village Code, Streets and Sidewalks, to include an appeals process for the removal of snow and ice on sidewalks.  This would add a method for appealing a violation of snow removal on sidewalks which currently is not in the code.

2. Public Hearing on Local Law Introductory 5 of 2021 to amend Chapter 70 of the Village Code,Alarm Systems, to update the appeals process for contesting denial, suspension, revocation orcharges.  This would add a method for appealing an Alarm System violation or charge which currently is not in the code.  3. Public Hearing on the Village’s Community Development Block Grant (CDBG) fundingapplication.  In order to apply and qualify for CBDG grants, the projects must be identified and apublic hearing must be held.  The four projects that the Village is considered applying for grantfunding for are: the improvement of the Brook Street parking lot, the replacement of the DobbsPark playground equipment and resurfacing of the Dobbs Park basketball court, the replacementof the retaining wall along lower Grand Street and the replacement of an existing sidewalk alongSouth Riverside Avenue between Oneida Avenue and Bungalow Road; 

CORRESPONDENCE:


a. Letter from Marjorie Blum & Jack Manno regarding a $1,000 donation for a bench at Croton Landing.   Ms. Blum and Mr. Manno have generously donated a bench for the park.

b. Email from Cynthia Lippolis of the Croton Rotary Club requesting permission to use the Croton-Harmon Train Station parking lot for their annual car show on September 26. As done last year, there will also be a car parade.

c. Temporary Restraining Order issued by the Westchester County Supreme Court in the matter of Maria Elena DiBella v. Village of Croton-on-Hudson, Croton-on-Hudson Planning Board and Half Moon Bay Homeowners Association. 

The court has issued a “temporary restraining order prohibiting THE BOARD OF DIRECTORSOF THE HALF MOON BAY HOMEOWNERS’ ASSOCIATION, INC. (the “HOA Board”)from paving the Discovery Cove Promenade until this motion is decided.” The matter was brought against the Planning Board, the Village of Croton and the HMB Homeowners Association by the homeowner.


d. Letter from Kelly Turturro, DEC Regional Director, regarding the Croton Gorge Unique Area.   The letter is a response to both County Executive Lattimer and Mayor Pugh.  It states that the DEC is continuing to monitor the situation, mentions the Trail Stewards will be returning this season on weekends and holidays and the DEC Forest Rangers will be monitoring the area as well.

eMemo from Daniel O’Connor, Village Engineer, requesting an extension of a building permit for 1250 Albany Post Road.   Mr. O’Connor recommends a building permit extension for 6 months due to construction delays related to Covid.

PROPOSED RESOLUTIONS:

a. Consider adoption of the 2021-2022 Bond Resolutions for the purpose of   funding the capital budget.  The resolutions are for bonding approval for items that were in the 2021/2022 Capital Budget that was approved in April.  The five resolutions/bonds total $909,509.

b. Consider authorizing the Village Treasurer to establish a trust account for donations towards the creation of the Black Rock Park bocce courts.  A special account will be created for this project.

c. Consider authorizing the Village Manager to execute an agreement with Croton-Harmon Car Service (dba J&S Taxi) for the rental of two spaces at the Croton-Harmon Train Station parking lot for the period beginning June 1, 2021, through May 31, 2023.   The Village extends the parking spot rental for two additional years to May 2023.

d. Acknowledge receipt of a special permit application from Joseph Lippolis for a first-floor residential dwelling at 368 S. Riverside Avenue and consider determining that the Proposed Action is a Type II Action under SEQRA and referring the necessary documents to the Village Planning Board as required by law.    The applicant received a variance from the ZBA for this use.  A special permit from the Village Board is now required.  The Board is referring it to the Planning Board for review and recommendations.

e. Consider authorizing the Village Treasurer to amend the 2020-2021 General Fund Budget in the amount of $2,765 for expenses related to sidewalk snow removal.  The Village has received $2765 from snow removal billings where the owners were charged for its removal.

fConsider scheduling a public hearing on Local Law Introductory 7 of 2021 to amend Chapter 108 of the Village Code, Dogs, to clarify the allowable hours for leashed dogs in Black Rock Park, for June 21, 2021, at 6 PM, via Zoom videoconference.   This calls for a public hearing to amend the law pertaining to hours for leashed dogs in Black rock Park.  The new language states that leashed dogs can be in the park in the same timeframes as allowed in the unleashed area of the park..

g. Consider authorizing the Village Manager to accept the proposal from AKRF of White Plains, New York, for consulting planning services for zoning updates to the Harmon/South Riverside Gateway zoning district for an amount not to exceed $35,000.  The Village Board is considering an expansion of the Harmon Gateway zoning to include additional parcels, including the Parking Lot A parcel, as well as considering permitting all residential uses in the Gateway area with a Special Permit.  AKRF will study the zoning requirements and implications of this proposal.

h. Consider awarding Bid 3-2021 for street resurfacing to Morano Brothers Construction of Croton-on-Hudson, New York, in the amount of $215,200.  As part of its annual street maintenance work, bids were solicited and 6 were received. Superintendent Balbi has recommended Morano  Brothers receive the contract.

i. Consider authorizing the Village Manager to execute a contract with Regan Development Corporation for the sale of the Village-owned property at 41-51 Maple Street.   The updated terms of acquisition and development call for a payment to the Village of $2 million with a PILOT of $70,000/year, increasing 3% annually, for 30 years as well as a User payment to the Village of $20,000/year for 30 years.

j. Consider authorizing the Village Manager to execute a support contract with Rio Supply for the period of July 1, 2021, through June 30, 2022, in the amount of $5,500.  Rio supplies the software that supports the Water Departments hand held meter reading.  The contract is for one year. k. Consider authorizing the Mayor to execute the Sponsor Authorization Form for the Croton-on-Hudson Fire Department Length of Service Award Program for 2020.  The list of eligible members was circulated in April 2021.  The Mayor must be authorized to sign it.

1.       Consider the appointment of Daniel Tucker to the position of Village Treasurer effective August 2, 2021, at an annual salary of $115,000. 

2.       Discussion on improvements to the Village Cable Access Channel and meeting broadcasts.  Software used for operating the tv station has expired and is no longer functional.  Bryan Healy proposes utilizing new software from G and G Technologies at $9,458.

3.       Discussion on proposed bocce courts at Black Rock Park.  The proposed courts would be located at the northern end of the park.

4.       Review of possible dog park locations in Village parks.   The Board will review two sketches, included in the backup documents, prepared by DPW Superintendent Balbi, for possible locations at Croton Landing Park and Gouveia Park.

5.       Discussion on amending the Village Code to permit limited non-resident access to Village parks and recreational areas.  Discussion will be on a proposal to establish a specific number of non-resident park permits.

PUBLIC HEARING:

a.      Public Hearing on Local Law Introductory 3 of 2021 to amend Section 230-44, Signs, of the Zoning Chapter of the Village Code to modify provisions related to signage in residential zoning districts.  The modifications to the sign law are meant to clarify what constitutes a temporary sign.  Residential properties, may have up to 3 signs, no more than 6 square feet in size and non-illuminated, which are no longer classified as temporary signs.

a.  Email from Joseph Martinelli, American Legion Post 505 Adjutant, regarding this year’s Memorial Day Ceremony.  
Post 505 is planning a ceremony on 5 Corners on Monday, May 31 at 11 am.  (Rain location is Holy Name of Mary gym.)  They will comply with all Covid safeguards.

b.      Email from Maria Slippen, chair of the Recreation Advisory Committee, regarding recommendations for Black Rock Dog Park.  The RAC puts forth its recommendation regarding Black Rock Dog Park as follows:

 1. Revise hours from the current Friday to Monday 10-4 and Tuesday through Thursday 8-11 and 4-7 to a consistent Monday through Saturday 8-8 and Sunday 10-2. 

  2. We reiterate our previous recommendation to open the Dog Park to school district residents (with proof of dog registration in the town and for a fee).

  3. We also suggest that parking rules at the park be clarified (sticker/ parking pass/village resident/school district resident) to avoid confusion.

PROPOSED RESOLUTIONS:

a.      Consider adoption of a Negative Declaration for SEQRA purposes and a finding of consistency with the Village’s LWRP in regards to the special use permit application from Regan Development Corporation for a proposed multi-residential building at 41-51 Maple Street.  At a recent meeting, the Board reviewed both the EAF Part 2 and the Coastal Assessment form for SEQRA and LWRP compliance.  Based on that review, they directed that the above referenced resolution be put on the agenda for adoption.

b.      Consider the issuance of a special permit to Regan Development Corporation for the construction of a multi-residential building at 41-51 Maple Street.  Following a recommendation from the Planning Board, the resolution calls for approval of the special permit subject to several conditions regarding traffic and pedestrian issues.

c.       Consider authorizing the Village Attorney to execute the proposed tax certiorari settlement for 1280 Albany Post Road for the years 2015-2020.  The property involved is the Sky View Nursing Home.  The settlement calls for the Village to reimburse them in the amount of $93,804 with $44,551.67 being taken from the Contingency account.

d.        Consider awarding Bid 01-2021 for tree trimming and removal services to Golden’s Tree Service of Montrose, New York, for the period beginning June 1, 2021, through May 31, 2022.  Four bids were received.  Golden’s was the lowest and is recommended by DPW Superintendent Balbi at a total of $70,500.

e.     Consider scheduling a public hearing on Local Law Introductory 4 of 2021 to amend Chapter 197 of the Village Code, Streets and Sidewalks, to include an appeals process for the removal of snow and ice on sidewalks, for June 7, 2021, at 6 PM, via Zoom videoconference.    The proposed change to the law specifies a process for a property owner to appeal the Village charge for snow removal.  A public hearing would be scheduled.

f.         Consider scheduling a public hearing on Local Law Introductory 5 of 2021 to amend Chapter 70 of the Village Code, Alarm Systems, to update the appeals process for contesting denial, suspension, revocation or charges, for June 7, 2021, at 6 PM, via Zoom videoconference.   A public hearing would be held to update the Alarms code to provide for an appeals process if an alarm permit is denied.

g.       Consider authorizing the Village Manager to execute an agreement for EMT services with the Mid-Hudson Ambulance District for the period beginning June 1, 2021, through May 31, 2022.  MHAD provides supplemental help, as needed to the Croton EMS.  This would extend the contract for another year at the rate of $25./hour.

h.      Consider scheduling a public hearing on the Village’s Community Development Block Grant (CDBG) funding application, for June 7, 2021, at 6 PM, via Zoom videoconference.  The Village intends to apply for CBDG funds for four proposed projects.  A public hearing on the merits of the proposed projects is required.  The four proposed projects are: Improvements of the Brook Street parking area, Replacement of Dobbs Park playground equipment, Replacement of retaining wall on Grand Street, Replacement of sidewalk on South Riverside Avenue between Oneida and Bungalow Road.

i.        Consider awarding Bid 02-2021 for the purchase of a plug-in hybrid vehicle to Tasca Ford of Berlin, Connecticut, at a price of $33,930.30.   The vehicle would be used by Parking Enforcement.

j.        Consider scheduling a public hearing on Local Law Introductory 6 of 2021 to amend Chapter 168 of the Village Code , Parks & Recreation Areas, to clarify the prohibition on dogs in parks, for June 21,2021, at 6 pm, via ZOOM videoconference.  This calls for a public hearing on the proposed amendment which would allow leashed dogs to be walked in Black Rock Park during the same hours as the dogs are permitted in the designated dog park.

DEMOCRATIC CANDIDATES FOR VILLAGE BOARD

Brian Pugh for Mayor
Brian Pugh is a native of Croton-on-Hudson, NY. Brian has served as Mayor of the Village since December, 2017, and as a Village Trustee from 2014 to 2017. Brian is a graduate of Oberlin College and earned a Juris Doctor at Fordham Law School. During Brian’s leadership as Mayor, Croton-on-Hudson became one of only two Villages in NY to earn a Silver Rating as a Climate Smart Community in recognition of the Village’s many environmental achievements. In addition to sustainability, Brian has championed investments in infrastructure, including the nearly completed Croton Point Avenue Improvement Project, controlling property taxes, and prioritizing affordability for residents.

Alejandro Rosales for Trustee
Alejandro Rosales is an eight-year resident of Croton-on-Hudson where he raises his young family including two boys who attend Croton public schools. During his time in Croton, Alejandro has been giving back to the community through his involvement with the Croton-Cortlandt Food Pantry and Holy Name of Mary’s Hispanic Ministry, among other local groups. Alejandro is a first-generation immigrant from Honduras and was raised in Los Angeles, California. He obtained a Bachelor’s Degree from UCLA and Masters from the School of International & Public Affairs (SIPA) at Columbia University. Alejandro carries with him 20 years of professional experience in the financial and nonprofit sectors. As a Village Trustee, Alejandro will focus on attracting investment, prudent financial planning, increasing civic participation, and creating spaces for dialogue between all Village residents.

Sherry Horowitz for Trustee
Sherry Horowitz was first elected to the Board of Trustees in 2017. Sherry has advocated for policies that promote diversity and inclusion, protect the environment, increase communication between government and residents, support Croton’s local cultural & arts community and increase affordable housing options in the Village. A Croton resident for more than 40 years, Sherry has owned and directed the Childrenspace Preschool since 1979. She holds a B.A. from Brooklyn College and a Masters in Teaching from Manhattanville. Sherry will continue to promote strong connections between residents, organizations and Village officials and personnel.

John Habib Memorial Video & Scholarship Fund

John Habib epitomized the best in what a Colgate University graduate should be.  He was intelligent, caring and above all, sought to help his fellow women and men.  He spent his life in service to that idea.  In furtherance of that legacy, the John L. Habib Memorial Scholarship for International Studies will assist worthy Colgate students in achieving their academic goals.

During his years at Colgate and beyond, John Habib epitomized the benefits of a liberal arts education generally, and of a Colgate education in particular.  Academically, John was passionate about international affairs, political science, ethics and world peace. He majored in International Relations and Political Science and participated in the Geneva Study Group and in a Washington, DC political science January term, each of which further fueled his passion for international relations. Outside the classroom, he was a lifelong athlete and played varsity baseball at Colgate and was president of the Alpha Tau Omega fraternity and a participant in the Big Brother-Big Sister program throughout college.

After college, John attended Emory Law School and was Editor-in-Chief of the Emory International Law Review.  Following law school, he had a varied career that, at various times, involved practicing law in Washington, DC and Phoenix, AZ; acting as general counsel and then president of a consumer products company; and establishing his own law firm in Abu Dhabi. He took leadership roles in a number of international trade organizations and chambers of commerce promoting trade in the MENA region.

After many years living in the Middle East and meeting and marrying his wife and legal partner, Tanya, he returned to his home town of Croton on Hudson, NY, where they opened yet another law practice. But John’s need to do service led him to create the Croton Business Council, to support the Village’s business community and eventually to run for elective office in Croton as a Trustee. John was very proud to serve the village where he had grown up and used every opportunity to leave his mark on the broader Hudson Valley area of NY, a place near and dear to his heart no matter where his travels took him. 

This of course is only a small fraction of who John was as a person. He never lost sight of the fact that he was, first and foremost, a husband, a son, brother and nephew, as well as a father to his foster son, Shadi, whom he helped support through a series of medical treatments when Shadi was young and then made possible a college education for Shadi in the United States. John valued human connection and cared deeply about people, not just those he knew but also all those he hadn’t gotten to know yet. Not surprisingly, he had countless friends around the globe spanning all phases of his life. When he spoke with you, he made you feel like you were the center of the universe. 

Above all else, John loved life, deeply and sincerely, and invariably had a smile on his face and something positive to say.  While John left us too soon, we can think of nothing better than to have his spirit carry on through a scholarship that honors his memory and legacy.

PUBLIC HEARING:

  1. Public Hearing on the special permit application from Regan Development Corporation for a proposed multi-residential building at 41-51 Maple Street.  Regan Development has applied for a Special Permit to construct at 33-unit apartment complex at this location.  It would consist of 11 1-BR, 11 2BR, and 11 3BR units.  The Village-owned  property was previously the subject of a Village-initiated RFP process in which the Regan Development was selected.

PRESENTATION/OTHER:

  1. Review of the Environment Assessment Form Part II and the Village’s Local Waterfront
    Revitalization Program policies by the Village Board to determine consistency related to the special use permit application from Regan Development Corporation for a proposed multi-residential building at 41-51 Maple Street. 
     As part of the SEQRA review process, the Village Board is required to review the Environmental Assessment Form for the project.  The Board must also determine the project’s consistency with the Village’s Local Waterfront Revitalization Program (LWRP) by review the Coastal Assessment Form.

CORRESPONDENCE:

  1. Letter from Kelly Turturro, Regional Director for New York State Dept. of Environmental Conservation, regarding funding for this year’s Croton River Stewards program.   The Village is copied on this letter to the NYNJ Trail Conference indicating the DEC’s intent to support the Croton River Stewards program and will contribute $20,000 to the program costs.
  2. Letter from George Latimer, County Executive, and municipal leaders requesting changes to the Croton Gorge Unique Area.   This letter to the NYS Dept. of Environmental Conservation requests that the DEC implement a registration/reservation system to control the number of visitors to the Croton Gorge Unique Area which belongs to the DEC.  It is co-signed by Supervisors Puglisi and Levenberg as well as Mayor Pugh.
c.     Memorandum from Chief of Police John Nikitopoulos regarding the new police patch designfor the Croton-on-Hudson Police Department.  As called for in Action #14 of the recentlyapproved Police Reform Plan, the Department has spent considerable time in evaluating potentialnew patch designs and have reached agreement on a design which features the American eagle.

PROPOSED RESOLUTIONS:

  1. Consider adoption of a resolution which rejects bigotry, ignorance and hate, in all of its forms.   This resolution is in response to the recent escalating verbal abuse and vicious, physical assaults on the Asian American and Pacific Islander community.  It encompasses all targeted, victimized and scapegoated populations.
  2. Consider authorizing the Village Manager to execute a renewal agreement with SeamlessDocs of New York, New York, for the hosting of online Village forms for the period of June 1, 2021, through May 31, 2022, at a cost of $3,300.   SeamlessDocs provides the support for forms and payments for the Village’s Recreation, Treasurer and Village Clerk Offices.

a.      Consider adoption of the 2021-2022 Village Budget for the fiscal year commencing June 1, 2021 through May 31, 2022.  The total appropriation for Fiscal Year 2021/2022 is $18,868,054 with $12,340,998 to be raised by taxes, meeting the Tax Levy Cap.  The proposed tax rate is $271.956 per 1000 of assessed valuation. This translates to an increase of $7.225 per 1000 or a 2.73% increase. 

b.      Consider the addition of past due receivables to the tax bills for the 2021-2022 fiscal year.

c.       Consider adoption of the Master Fee Schedule for 2021-22.  On an annual basis, the Board updates its Fee Schedule for various permits, activities, licenses, etc.

d.      Consider authorizing the Mayor to sign the Tax Warrant for the collection of taxes for the period commencing June 1, 2021 through May 31, 2022.
