REGULAR MEETING

Executive Session at 5:30.. Consider a request from the Village Manager to enter into executive session to discuss the proposed acquisition, sale or lease of real property.

PRESENTATIONS/OTHER:   Review of the Environment Assessment Form Part II and the Village’s Local Waterfront Revitalization Program policies by the Village Board to determine consistency related to the special use permit application from Ralph Rossi and Philip Spagnoli for the construction of a multi-residential building at 25 S. Riverside Avenue.  The Board will review these forms as a required part of the Special Permit process under consideration. 

PROPOSED RESOLUTIONS:

  1. Consider authorizing the Village Manager to execute the Mutual Aid and Rapid Response Plan Inter-Municipal Agreement with Westchester County for the period beginning July 31, 2020, through July 30, 2025.  This authorization was held over from a previous meeting.  The IMA is a renewal which permits mutual assistance among departments based on their resources and specialized skills.
  2. Consider authorizing the Village Manager to execute Change Order 8 with Hendrickson Fire Rescue Equipment of Islandia, New York, for changes made to the design of the 2018 Triple Combination Pumper, in the credit amount of $139.27.  This Change order is for the elimination of one item from the pumper as it is being customized to Croton’s specifications.
  3. Consider authorizing the Village Manager to execute the STOP-DWI Patrol Program Inter-Municipal Agreement with Westchester County for the period beginning January 1, 2021, through December 31, 2025.   This is a 5-year renewal of a program that reimburses Croton Police up to $8400 for overtime work associated with driving while intoxicated.
  4. Consider authorizing the Village Treasurer to make an interfund transfer in the amount of $2,161.96 for monies received from the New York State Governor’s Traffic Safety Committee grant.  This is grant money based on various Police Traffic Safety activities as reported to  NYS for reimbursement.
  5. Consider authorizing the Village Manager to execute an agreement with Penflex, Inc. to administer the Fire Department Length of Service Award Program (LOSAP) at an estimated cost of $6,850.00 for the period beginning November 1, 2020, until October 31, 2021.  The Fire Department Service Award program was begun in 2003. Penflex provides actuarial and administrative services needed to administer the program.
  6. Consider authorizing the Village Manager to award the bid for welding services to John Santella Welding of Putnam Valley, New York, at the rate of $94/hour for the welder and $89/hour for the welder’s helper, for a total of $25,620, for the period beginning December 6, 2020 until December 5, 2021.  The bid was the lowest of two bids received to provide welding services for the Village for welding that cannot be performed in-house during the coming year.
  7. Consider authorizing the Village Manager to accept the proposal from Stratagem Security of Elmsford, New York, for the installation of an intercom system at the Municipal Building in the amount of $10,298.71.  In and effort to increase the safety and security of the Municipal Building, this system would secure the entrances.  Each department would be able to view visitors remotely and remotely unlock the door for entrance.
  8. Consider authorizing the Village Manager to accept the proposal from Metrocom of Bedford Hills, New York, for a replacement police radio base station in the amount of $7,106.75 and further authorizing the Village Treasurer to make an interfund transfer in the same amount.  The police base radio station is 20 years old and no longer properly functioning.  It is past its useful life and is no longer serviced by Motorola.  This allows the money to be taken from the Contingency account since this expense was not part of the approved Budget.
  9. Consider authorizing the Village Treasurer to establish a special capital account with the monies received from the sale of two surplus vehicles to the Town of Cortlandt.  The Town of Corltandt is interested in purchasing the 2 Village dump trucks that are being replaced at $35,000 each.  This is considered a fair market price.  Superintendent Balbi would like the Board to create a new capital account for the purpose of reserving this money for the purchase of future DPW equipment.
  10. Consider determining that the Proposed Action, a lease agreement for a portion of the Croton-Harmon Train Station parking lot for the installation of solar canopies, is an Unlisted Action under SEQRA, declaring the Village Board as Lead Agency under SEQRA, and referring the necessary documents to the Waterfront Advisory Committee for a recommendation of consistency with the Village’s Local Waterfront Revitalization Program.  The Village put out a request for proposals for solar canopies at the Train station.  Seven proposals were received.  The Village is working with Sol Systems of Washington DC to work out a mutually agreeable lease.  This action moves the process forward by declaring the Village as Lead Agency for this proposal.

1.      Introduction to Police Reform and Reinvention Collaborative Process.  This process is the result of Executive Order 203 from Governor Cuomo issued in June 2020.  It requires that each municipality with its own police department conduct such an analysis.  The Village called for volunteers shortly after and has a Task Force of some 22 members.  They have conducted 7 Forums and a written survey since then.  The Task Force has met in full 8 times and has formed subcommittees which will be reported on during this work session.  The Board of Trustees must submit a report and plan to NYS by April 1, 2021. 

Back up documents for this meeting include a review of the comments received from the public at the forums, in the survey and from emails sent to the Village.  The report from the Analysis sub-committee provides a data analysis from all the above information as well as Police Department statistics.  All the backup reports are available on the Village website for this meeting’s agenda.

1. Filing of oath of office of newly elected members of Board of Trustees. Please note the Oath of Office book for the Newly Elected Trustees has been signed prior to the meeting. 

2. Mayor’s Appointments  

3. Consider adoption of the Procurement, Fund Balance, Debt and Investment Policies.

4. Consider adoption of the schedule for the Board of Trustees meeting place, dates and times for the upcoming official year.

5. Consider designating the Gazette as the Village’s Official Newspaper and The Journal News as an on-needed basis.

6. Consider establishing the standard work day for employees as outlined.

7. Consider setting bond levels for the following employees: Village Treasurer, Deputy Village Treasurer, Court Clerk, Senior Account Clerk.

REGULAR MEETING

PUBLIC HEARINGS:

  1. Public Hearing on the special use permit application from Ralph Rossi and Philip Spagnoli for the construction of a multi-residential building at 25 S. Riverside Avenue.

The  proposal is for a 39- residential unit building at the site of the former Croton Hardware building.

  1. Public Hearing to consider the adoption of Local Law Introductory No. 8 of 2020 to amend Chapter 191, Sewers, of the Code of the Village of Croton-on-Hudson to update language regarding on-time payments. This proposed amendment to the Sewer Rent law is a wording change to clarify the date by which sewer bills must be paid.
  1. Public Hearing to consider the adoption of Local Law Introductory No. 9 of 2020 to amend Chapter 223, Water, of the Code of the Village of Croton-on-Hudson to update penalty procedures.  This proposed amendment updates outdated language in the existing law that refers to 2017.

CORRESPONDENCE:

  1. Memo from Daniel O’Connor, Village Engineer, requesting an extension of a building permit for 370 South Riverside Avenue.  Engineer O’Connor recommends a six month extension of the permit due to unforeseen circumstances.
  2. Email from John Munson, Fire Council Secretary, regarding membership changes in the Croton Fire Department.  As required, the Fire Dept. is notifying the Village of changes in status of department memberships.
  3. Report of the 2020 Croton Gorge Unique Area Trail Steward Program.  The report describes the aims of the Trail Steward Program.  The closure of the Unique Area due to the pandemic added a new dimension to the stewards duties. The complete report is available in the backup to this meeting.
  4. Notice from the Village of Haverstraw Board of Trustees, pursuant to SEQRA, regarding the adoption of Village of Haverstraw Comprehensive Plan, Local Waterfront Revitalization Program (LWRP) and implementing code amendments.  This is a Type 1 action under NYS SEQRA law and requires notification of surrounding communities of the action.
  5. Notice of Public Hearing from the Town of Ossining Planning Board regarding an application by Borrego Solar Systems Inc. to construct a standalone energy storage system on the property located at 381 N. Highland Ave. in Ossining.   The proposal is for a standalone energy storage system to be located on the property of ST. Augustine’s church in Ossining, adjacent to the Croton village boundary.  The hearing is on December  16 at 7:30 by Zoom.

PROPOSED RESOLUTIONS:

  1. Consider authorizing the Village Manager to execute the Mutual Aid and Rapid Response Plan Inter-Municipal Agreement with Westchester County for the period beginning July 31, 2020, through July 30, 2025.    The purpose of the IMA is to provide uninterrupted delivery of police service during situations that exceed the resources of any individual department.
  2. Consider authorizing the Village Manager to execute Change Order 7 with Hendrickson Fire Rescue Equipment of Islandia, New York, for changes made to the design of the 2018 Triple Combination Pumper, in the change amount of $4,469.26.  The pumper is being tailored to meet the Village’s specifications.  This has resulted in a change being made to the original bid, i.e. a Change Order.
  3. Consider authorizing the Village Treasurer to make an interfund transfer in the amount of $1,327 to provide funding for the purchase of a laptop computer. The money is available is the Water Fund and would be transferred to a general fund account.
  4. Consider authorizing the Village Manager to execute an agreement with Joseph Lippolis of Berkshire Hathaway HomeServices River Towns Real Estate to market the residential building located in Gouveia Park at 1300 Albany Post Road for commercial occupation at the rent of $6500 per month.  A 5-year lease is proposed to help cover maintenance costs of the property until a long-term use for the Village-owned building is agreed upon.
  5. Consider authorizing the Village Treasurer to amend the 2020-2021 Sewer Fund Budget in the amount of $832.50 for monies received for insurance recovery.  The recovery is for repairs following a fallen tree at the Nordica Pump station.
  6. Consider authorizing the Village Manager to execute a contract extension (under the authority of GML Section 103(4)) with NSI Worldwide of Middletown, New York, for the period of December 1, 2020, through January 31, 2021, at a cost of $3,276.00 per month.   NSI Worldwide performs the cleaning of Village-owned buildings.
